1. Acceptance of Terms

By using the Arborium application, you agree to be bound by these Terms and Conditions of Use. If you do not agree to these terms, you must not use or access the application.

2. Intellectual Property Rights

All content in the application, including text, graphics, logos, and tree images, is the property of Arborium App LLC and is protected by international copyright laws.

3. Use of the Application

The Arborium application allows users to register public and private trees. This registration does not imply ownership or carbon credit rights by Arborium App LLC or the user. The application aims to raise awareness about the importance of trees in capturing CO2 and to help society understand how nature can offset carbon footprints.

4. NFT Conversion and Ownership

4.1 Tree Images as NFTs

Arborium App LLC intends to convert tree images into Non-Fungible Tokens (NFTs) for unique identification.

4.2 NFT Ownership and Arb Coins

Ownership of these NFTs is linked to the user’s account. Owners of the NFTs are eligible to collect Arb Coins associated with the respective trees.

5. Right to Remove User, Trees, and Revoke Credits

Arborium App LLC reserves the right, at its sole discretion, to remove any user or tree record from the application for various reasons. This includes duplicated records, incorrect use of the application, sabotage, non-compliance with community rules, or any other reason deemed necessary. The removal of a tree record or user may result in the revocation of any credits and Arb Coins associated with that tree or user.

6. User's Right to Exit

Users may opt-out of the platform and request the deletion of their personal data by sending a request via e-mail to info@arborium.app. Upon exit, tree images and Arb Coins associated with the user's account will be transferred to Arborium App LLC.

7. Privacy

Arborium App LLC is committed to protecting user privacy as outlined in our Privacy Policy.

8. Disclaimer of Liability and No Warranty

Arborium App LLC, its employees, directors, and shareholders are not liable for any damages arising from the use of the application. The application is provided "as is" without any warranty.

9. Modifications to Terms

Arborium App LLC may modify these Terms and Conditions at any time, with continued use of the application constituting acceptance of these changes.

10. Arb Coins and Compensation

Arb Coins are symbolic and have no real monetary value. Arborium App LLC does not commit to compensating, reimbursing, or indemnifying users under any circumstances.

11. Indemnification

Users agree to indemnify Arborium App LLC against any claims arising from the use of the application or violation of these Terms.

12. Dispute Resolution

Any dispute related to these Terms will be resolved through binding arbitration as determined by Arborium App LLC.
